Terms of Service

These Terms of Service ("Terms") govern your use of the HomeAI application ("the App") published by Philippe B. By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Description of Service
HomeAI is a smart home assistant application that connects to your Home Assistant server and uses third-party AI providers to process natural language commands. The App acts as a client interface — it does not operate servers, store your data remotely, or provide AI services directly.
2. User Responsibilities
- API Keys — You are responsible for obtaining and managing your own API keys for AI providers (Anthropic, OpenAI, Google, etc.) and optional services (TTS, Whisper). You are responsible for any costs incurred through your use of these third-party APIs.
- Home Assistant — You are responsible for setting up, maintaining, and securing your Home Assistant server. The App connects to the server URL and access token you provide.
- Account Security — You are responsible for keeping your API keys and Home Assistant tokens secure. Do not share your device with untrusted individuals while these credentials are configured.
3. Smart Home Actions
The App uses AI to interpret your requests and execute actions on your smart home devices. By using the App, you acknowledge that:
- AI responses may occasionally be inaccurate or unexpected.
- The App may control physical devices in your home (lights, locks, thermostats, etc.) based on AI interpretation of your commands.
- You are solely responsible for reviewing and accepting the actions the AI takes on your behalf.
- You should exercise caution when using the App to control security-sensitive devices such as locks, alarms, or cameras.
4. Third-Party Services
The App relies on third-party services that are outside our control. Your use of these services is governed by their respective terms:
- Anthropic — anthropic.com/terms
- OpenAI — openai.com/terms
- Google — ai.google.dev/terms
- Home Assistant — home-assistant.io/tos
We are not responsible for the availability, accuracy, or conduct of any third-party service.
5. No Warranty
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure.
- AI-generated responses or actions will be accurate or appropriate.
- The App will be compatible with all Home Assistant configurations.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Philippe B shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Damage to property resulting from smart home actions executed by the App.
- Costs incurred from third-party API usage.
- Loss of data or unauthorized access resulting from device compromise.
7. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the App after any modification constitutes acceptance of the revised Terms.
8. Termination
You may stop using the App at any time by deleting it from your device. Use the "Reset to Factory Settings" option before uninstalling to remove all stored credentials from the Keychain.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
